    Hello, I'm trying to set up a company here in the U.S.
    I'm a U.S. citizen, but I would like to have my nephew to come work for me. The thing is that he is not a u.s. citizen, can I sponsor him for a H1B visa? Is it likey that he will get it? (I understand that most of the H1B visas go for big companies)

    Thank you for your time in answering this. I am interested in setting up an online company that will sell products in the US from US wholesalers and suppliers. This requires I have some kind of entity set up to legalize the process. Firstly, Is this 'entity" and method of doing business able to be done legally without any implications?     I am not USA resident. I am currently living in Chicago on a student (F1) visa and I am on my OPT program (1 year of work permit) and I am driving a truck. I am wondering about how to collect profits from the business when my work permit expiry and I am not allow to work in the US any more? I have concluded that an LLC in Illinois would be the best fit. My further plans are to purchase couple of trucks and to hire drivers who will work for my LLC.

    My question is: If I open a LLC, will I be liable to US regarding tax income? Or my LLC business?

    Good day. I am Ukrainian citizen and temporarily live in the USA as F1 student. I am interested in extending my business and would like to incorporate a company in the USA which will be involved in selling sports products and sports equipment. Two questions arised in regard to incorporation I would like to be familiar with:

  8. US LLC with a non-US partner and a US partner

    Hello,

    I'm interested in forming an LLC. I am not a US citizen and I do not live in the US. I would be forming the LLC with a partner who is a US citizen and lives in the US.

    Questions are:

    1) Is is possible to have two partners from different nationalities? (I would guess it is)

    2) How would the money be transferred to me being international? Can the LLC make international wire transfers? Or will I need a US bank account?

    3) Do I have to pay taxes in the US or in my home country?

  10. A foreigner setting up company while working the the U.S.

    I'm a foreign citizen currently working for a British company in the U.S. I've had a business idea that i want to explore and i am wondering how i can go about pursuing the idea. My understanding is i can start a company, however i can't actually work for the company, which kind of makes it difficult to get off the ground.

    My question is am i allowed to start and work for the company as long as I'm technically volunteering i.e. i wouldn't draw a salary and any money I make would be through profits paid by the company?

    The 2nd option i have considered is forming the company in the UK and working for it. However as i am resident in the U.S. would that cause issues when I try and sell to U.S. companies?

    Respected sir,
    I am an international F1 student, Through lots of contacts to immigration lawers and government of USA including USCIS and homeland security of USA, they said I can open or own a business or corporation In USA and take profits from it paying proper taxes but you cannot take paychecks and pay tax from any company including your own.
    Question is as you have told me last time, that you can own a corporation but not S corporation , can i register an incorporation or is that S corporation or how to know is that c corporation while registering a business? And one more question is:
    Can I include my name as director or that means i work for that business while registering a corporation...i need your help to differentiate between c corporation or s corporation?

  15. Virtual company, taxes and paying oneself (for a foreigner)

    Hello guys,

    I'm not an US citizen (although I do have a B1/B2 Visa). I'm currently a freelance software engineer/web designer working remotely from home. Most of my clients are from the US, and some are big companies. I want to start treating this as a business instead of a freelance job, and in order to do that I need to look more professional, and having a LLC is a good start.

    Considering I'll not be living in the US and that my work is mainly web-development services that I do from where I live (and eventually digitally-delivered products such as ebooks), what kind of taxes apply?

    (I think I've read that if you prove that you don't have assets in the US and that you don't sell physical goodies, you don't really pay taxes at all, is that correct?)

    Also, how can I pay myself? I already have a personal bank account in the US (my clients currently deposit to this one) and I'm willing to open a business one. How's the process of paying yourself if you're the only managing member of the and what taxes apply (also considering my situation, as stated above)?

    I am holding an H1B visa and currently in the US. I would like to start an e-commerce business that sells digital goods. I would also provide customization on these digital goods for the customers, which would be billed extra. Can you please provide answer to the below questions?
    1. Am I legally allowed to start e-commerce business?
    2. If yes, how should I proceed with registration (I am in Texas now)? Will consulting a CPA provide the required information?
    3. I would like to open a bank account in the US to receive payment from the customers. Is it possible to open one? Can you give an idea on what documents they would ask for?

    When incorporating in the US as a foreigner, what is the best way to have a local address (for mail and to make the whole presence look more professional)? I know there are mail forwarders and "virtual offices", but not sure what's the right one for the case, I'm kind of confused. Also, in the case of the address given to the IRS when the company is opened, can it be a non-US address? Can it be changed later?

    I'm not a US-citizen, I already asked around and your support staff told me that it is possible for me to form a LLC in the US, but how do you guys manage to get an EIN without a SSN? How's the company be tied to me, in this case? Am I going to be legally the owner or is there any "informal tricks" behind that?

    I am a Turkish citizen working for a software company here in Maine. I have neither Green Card nor US citizenship as I work on H1B. I will be moving back to Turkey at the end of this month and continue working remotely for the same company as now. My employer said I won't be on their payroll anymore but I need to start up my own business to send bills to them.

    I already have a checking and savings account here and can open a business checking account too if I want to start up an LLC in Maine.

    What are my options as far as working remotely from Turkey and billing my employer using my LLC? Is this legal? Am I going to pay taxes and is it going to be based W8-BEN and 30% tax rate? Any other fees that I will need to pay?

    1) I'm the only one to own the LLC but i have few people working under me and all works will be done from here. Do i need to have a business name here in Philippines before i can register for LLC in US?
